This application for regular bail arises out of Bhagwanpur Hat P.S. Case No. 20 of 2020, disclosing offences punishable under Sections 30(a) and 41(1) of the Bihar Excise Prohibition Act, 2016.

From the petitioner's house, the police are said to have recovered 30 liters of country made liquor. Learned counsel for the petitioner has submitted that only because he was found fleeing away from his house, he was apprehended by the police and has been implicated though the house in question is jointly held by other members of the family. It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent. The petitioner is in

Patna High Court CR. MISC. No.10581 of 2020(2) dt.02-03-2020 2/2 custody since 24.01.2020.

Considering the fact and circumstances and particularly the quantity of illicit liquor said to have been recovered, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge, Siwan in connection with Bhagwanpur Hat P.S.
