It is submitted by the learned counsel for the State that the Service Appeal of the petitioner bearing Service Appeal No 435 of 2013 was filed before the Commissioner and was dismissed for default. The same was restored on 30.06.2014 and was transferred to the Court of Deputy Director (Welfare). Thereafter, it has been transferred to the District Magistrate, Sheohar under order dated 26.08.2015.

Under these circumstances, there is no occasion for this Court to take up the matter as the issues are yet to be decided by the District Magistrate, Sheohar. Petitioner's counsel complains that the matter has been kept pending inordinately. In view of the aforesaid submission, writ petition is disposed of with a direction to the District Magistrate, Sheohar to conclude the hearing of the appeal expeditiously after hearing the necessary parties in accordance with law and dispose it of by a reasoned and speaking order within a period of three months from the date of receipt/production of a copy of this order.
