Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Bhargama P.S. Case No. 01 of 2020 registered for offence punishable under sections 147, 148, 149, 447, 341, 323, 324, 307, 379, 354, 504 and 506 of the Indian Penal Code. The learned counsel for the petitioner has submitted that there is a previous enmity between the parties and the petitioner side has also lodged a case with similar allegation

Patna High Court CR. MISC. No.23234 of 2021(3) dt.25-02-2022 2/2 against the informant prior to lodging of the present FIR. The allegation against the present petitioner is that he assaulted Sakhar Khan with farsa on his head. The injury report of Sakhar Khan has been received. The nature of injury is simple.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Araria in connection with Bhargama P.S. Case No. 01 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
