Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR relates to an occurrence of theft of tractor by unknown criminal. The tractor was recovered from the house of co-accused Makardhwaj Singh who has already been allowed bail by a Coordinate Bench of this Court vide order dated 28.02.2018 passed in Cr. Misc. No. 11991 of 2018 (Annexure-2). The petitioner and others were also arrested from the house of Makardhwaj Singh.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.16945 of 2018 (2) dt.28-03-2018 P2/ Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihiyan Police Station Case No. 386 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
