Petitioner, already in custody, seeks bail in connection with Karpi P.S. Case No.145 of 2017, registered under Sections 307 and 34 of the Indian Penal Code. Later on Sections 302 and 120(B) IPC were added.
Learned counsel for the petitioner seeks bail on the ground of parity as similarly situated other co-accused Bijendra Kumar, Dina Nath Singh and Md. Ayub Ansari have been admitted to bail by coordinate Bench of this Court by orders dated 07.02.2018 and 17.01.2018 passed in Cr. Misc. Nos.2218 of 2018, 59478 of 2017 and 57292 of 2017 respectively, there is no other evidence against the petitioner except disclosure of his name with others in the confessional statement of one Santosh
Patna High Court Cr.Misc. No.14222 of 2018(2) dt.13-03-2018 2/2 Kumar, the petitioner is in custody since 12.09.2017 and he has no criminal antecedent except one registered under Sections 420, 467, 468 and 471 of the Indian Penal Code. Having considered the said facts and circumstances, petitioner Santosh Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Arwal, Jehanabad in connection with Karpi P.S. Case No.145 of 2017.
