JUSTICE MIHIR KUMAR JHA ORAL ORDER 28-09-2015 Learned counsel for the petitioner has submitted that this application has been filed assailing the order of Panchayat Secretary by which the petitioner's services were terminated. He has also submitted that against such order, there is an appeal prescribed under the Bihar Panchayat Teacher Appointment Rules, 2006 before the competent District Teacher Employment Appellate Authority (hereinafter to be referred to as 'the Tribunal') and, therefore, he wants to withdraw this application in order to enable the petitioner to move competent Tribunal. This Court, without expressing any opinion on such submission, will simply accord leave to the petitioner to withdraw
Patna High Court CWJC No.3811 of 2012 (3) dt.28-09-2015 this application for moving appropriate Tribunal if so permitted under the relevant rules.
It is, however, made clear that the petitioner now will have no liberty to move this Court again for the same cause of action raised herein.
