====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-03-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 307, 504 of the Indian Penal Code.

3. Allegation against these petitioners is of commission of assault by means of lathi, danda to the informant and his brother causing injury to them.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. As a matter of fact, on the alleged date of the occurrence, it was the informant and his family members who assaulted the

Patna High Court CR. MISC. No.15644 of 2024(2) dt.14-03-2024 2/2 petitioners and their family members in which father of these petitioners died for which petitioner No. 1 lodged Tajpur P. S. Case No. 624/2023 of the offences under Section 147, 149, 341, 307, 302, 504 of the Indian Penal Code on 26.10.2023. Injury allegedly caused by these petitioners is simple in nature. Petitioners claim clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Samastipur in connection with Tajpur P. S. Case No. 657 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
