The petitioner seeks bail in Ahiyapur P.S. Case No. 174 of 2017 registered under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is that on his order, his son Suraj Kumar fired which hit on the head of the grandson of the informant.

Leanred counsel for the petitioner submits that witnesses have stated in F.I.R. that injured got injures on account of pelting of stones. There is no allegation of assault against the petitioner. Petitioner is an order giver. Petitioner is a military man.

Patna High Court Cr.Misc. No.21316 of 2017 (2) dt.10-05-2017 2/2 Considering the facts aforesaid and the fact that the petitioner has remained in jail for about two months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 174 of 2017.
