JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 8.4.2017 passed in Cr.Misc.No.16886 of 2017 with direction to learned trial court to conclude the trial within a period of six months.

Submission of learned counsel for the petitioner is that the case was posted for judgment but in the meantime a petition under Section 311 Cr.P.C. was filed on behalf of prosecution and the same was allowed for marking the document, against which the petitioner preferred an application before this Court, which is pending, as such, trial could not be concluded and petitioner is in custody for more than six years.

Heard learned APP also.

Having heard both sides and in the facts and circumstances and as earlier prayer for bail was rejected by this Court and trial could not conclude as petitioner preferred an application against order passed by learned trial court for marking

Patna High Court Cr.Misc. No.14229 of 2018 (2) dt.21-03-2018 2/2 a document under Section 311 Cr.P.C., I am not inclined to grant bail to the petitioner.

Accordingly, this application is dismissed.
