JUSTICE RAJIV ROY ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and the learned APP for the State The petitioner apprehends his arrest in connection with Town P.S. Case No.330 pg 2011 instituted under Sections 302,201,120B of the Indian Penal Code lodged on 12.06.2011 by the informant Suresh Singh.

As per the prosecution story, when the informant was on night patrolling he saw lying dead on the side of the road of post office. On inquiry, the private guard present there informed that two three persons came in a white coloured Bolero vehicle and kept the said person on the roadside stating that he has consumed excess wine and has fainted. Accordingly, the FIR was lodged.

A perusal of the FIR shows that the matter is of 2011

Patna High Court CR. MISC. No.13363 of 2023(2) dt.22-05-2023 2/2 and 12 years, later the present petition has been preferred for grant of anticipatory bail.

As the case been lodged under Section 302, 201, 120B of I.P.C, no case for any relief can is made out. Accordingly, the petition stands dismissed.
