Petitioner, already in custody, seeks bail in connection with Nirmali P.S. Case No.41 of 2017, registered under Sections 302, 201, 379 and 120(B) of the Indian Penal Code. Allegation in brief is that the accused persons called the son of the informant from his home and thereafter his dead body was found.
It is submitted that there is no eye-witness to the occurrence and petitioner seeks bail on the ground of parity as three co-accused, similarly situated, have been admitted to bail by coordinate Benches of this Court vide Cr. Misc. Nos.56368 of 2017, 11937 of 2018 and 12303 of 2018 on 04.01.2018, 27.02.2018 and 28.02.2018. In one of these matters it is
Patna High Court Cr.Misc. No.16505 of 2018(2) dt.27-03-2018 2/2 mentioned that during course of investigation it revealed that Shailendra Kamat had committed the murder.
Having considered the aforesaid facts and circumstances, petitioner Bittu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Birpur, District Supaul in connection with Nirmali P.S. Case No.41 of 2017.
