The petitioner is accused in connection with S.T. No. 451A of 2006/26 of 2012 arising out of Madanpur P.S. Case No. 49 of 2006 registered under sections 302, 307, 326, 341, 342, 379, 435, 427, 34 of the I.P.C., section 27 of the Arms Act and 3⁄4 of the Explosive Substance Act pending in the Court of Additional Sessions Judge-I, Aurangabad.
Submission is that petitioner is innocent and has falsely been implicated in this case. It is also submitted that petitioner is in custody since 23.07.2015 and he has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State
Patna High Court Cr.Misc. No.21235 of 2017 (4) dt.24-07-2017 2/2 opposed the prayer of the petitioner with submission that there is specific allegation of murder against the petitioner and others. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, Trial Court is directed to expedite the trial within six months.
