The petitioner has filed the present writ petition seeking a direction to the respondent State authorities for creation of Jamabandi in favour of the petitioner with respect to the lands in question mentioned in paragraph 1 of the writ petition and thereafter accept the rent and issue rent receipt in favour of the petitioner.
Though, the matter was argued for sometime, but the learned counsel appearing on behalf of the petitioner has fairly conceded that an appropriate petition has not been filed by the petitioner under the provisions of The Bihar Land Mutation Act, 2011 (in short 'Act, 2011') before the prescribed authority for grant of appropriate relief(s) with respect to the lands in question. In above view of the matter, the petitioner is granted liberty to approach the prescribed authority under the provisions of the Act, 2011 for grant of appropriate relief(s) with respect to the
Patna High Court CWJC No.5906 of 2014 (2) dt.29-06-2016 lands in question.
If such a petition is filed on behalf of the petitioner within a period of one month from today with a certified copy of the present order, then the prescribed authority shall register an appropriate proceeding under the provisions of the Act, 2011 and shall pass appropriate final order strictly in accordance with law, but, before passing any final order, an opportunity of hearing must be given to all concerned including the petitioner, concerned State authorities and the private individuals, if any. The writ petition stands finally disposed of with the observations and directions made above.
