The petitioner is seeking regular bail in G.R.P. (Patna Jn.) P.S.Case No. 70 of 2017 for the offences registered under Sections 401, 414, 379 and 411 of the Indian Penal Code. The allegation as contained in the Fardbeyan would show that during patrolling duty , the Sub Inspector of Police, Railway Police Station, Patna Junction found three persons in suspicious stage. It is alleged that the police chased the persons and out of three, two persons were caught hold by the police. Out of the two, one is the petitioner. It is further alleged that on search of the person of the petitioner, one black colour mobile without SIM and one black colour purse containing two blades and an ATM card of Punjab National Bank on which Rahul was inscribed

Patna High Court Cr.Misc. No.21165 of 2017 (3) dt.06-06-2017 2/2 and a bunch of keys and thirty rupees were recovered. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent as stated in para 3 of the petition. He further submits that recovery made from the petitioner itself is not suggesting commission of the crime and, according to him, the petitioner is in custody since 12.02.2017 and, therefore, deserves to be enlarged on bail. Learned A.P.P. opposed the prayer for bail.

Considering the fact that the petitioner has no criminal antecedent and he is in custody for approximately four months, I am inclined to enlarge the petitioner on bail. Let the petitioner, namely, Rahul Kumar, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M,Railway, Patna Junction in G.R.P. (Patna Jn.) P.S.Case No. 70 of 2017.
