The petitioners seek bail in a case instituted for the offence under Sections-30(a) & 56(G) of Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that 22.5 litres wine is recovered.

It has been submitted on behalf of the petitioners that petitioners are in custody since 20-02-2018 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that 22.5 litres wine is recovered from dicky of the car, in question. There is no compliance of Section100 Cr.P.C.

Patna High Court Cr.Misc. No.14129 of 2018 (2) dt.15-03-2018 On behalf of the State, it is submitted that petitioners are named in the F.I.R./complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Gaya in connection with Gaya Excise Case No. 77 of 2018.
