JUSTICE MADHURESH PRASAD ORAL ORDER 30-05-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

This is a case registered under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the informant contacted with her husband on mobile phone at 6.41 P.M. in the evening, but after sometime, the mobile phone got disconnected. Learned counsel for the petitioner submits that the statement made in paragraph-12 levelled specific allegation against Anjani Thakur, who has caused firearm injury to the deceased. It has come that the occurrence has taken place in the house of Deepak Kumar. Similarly, the statement of other

There is no other material of any overt act against the petitioner. The petitioner is said to be in custody since 16.02.2017. Co-accused Deepak Kumar @ Deepak has been granted bail vide order dated 27.03.2017 passed in Criminal Miscellaneous No. 6124 of 2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistratecum-Sub Judge-III, Muzaffarpur in connection with Mushari P.S. Case No. 134 of 2016.
