2. The petitioners seek bail in connection with Neemchak Bathani P.S. Case No. 176 of 2023 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
3. As per the prosecution case, the deceased has been killed because of having an affair with one Sangeeta Kumari.
4. Learned counsel for the petitioners submits that the petitioner is innocent and has committed no offence and have been falsely implicated in this case. They are in jail since 26.09.2023. It has further been submitted by Mr. Shamsi that the
Patna High Court CR. MISC. No.15243 of 2024(10) dt.31-01-2025 2/2 trial has been delayed and only charges have been framed.
5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
6. Considering the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM II, Gaya in connection with Neemchak Bathani P.S. Case No. 176 of 2023, subject to the condition that petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain present physically or through his advocate as directed by the Court.
