2. Petitioner apprehends arrest in case registered for the offence punishable under Section 3 of the Railway Property (Unlawful Possession) Act.

3. It is alleged that motorcycle of the petitioner was seized from the spot, where stolen articles were recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has got no concern with the stolen articles and his name transpired merely because his motorcycle was parked at the place of occurrence. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the fact that petitioner is owner of the motorcycle in question, prayer for anticipatory bail of the petitioner is refused.
