JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 149, 341, 323, 353, 332, 427, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners is that they were in the mob and had done violent activities towards the injured persons and the police.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have been made accused due to mistake of fact. On the accident of one person, a protest was made by the villagers regarding the compensation to be given to the family members of the deceased who had died in the accident. No specific allegation has been made against the petitioner nor any overt act has been alleged against them. General and omnibus allegation has been made against the petitioners.
Patna High Court Cr.Misc. No.8256 of 2016 (2) dt.09-03-2016 2/2 On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Rahul Kishore learned Judicial Magistrate, Ist Class, Begusarai, in connection with Phulwaria P.S. Case no. 180 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
