JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 399, 402, 413, 414 of the Indian Penal Code and u/s 25(1-B)a, 26, 35 of Arms Act. As per the prosecution case, on secret information a raid was conducted and this petitioner along with four other accused persons were apprehended on the spot. On search, one motor cycle has been recovered from the possession of this petitioner.

It is submitted that no stolen motor cycle has been recovered from the possession of this petitioner and he has been made accused only on suspicion. Petitioner is in custody since 13.01.2022 and investigation in this case is complete. Learned counsel appearing for the State opposes the

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj PS case No.17/2022.
