JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kanti P.S. Case No. 03 of 2017, registered under Sections 379 and 411/34 of the Indian Penal Code.

The accusation is that four persons were seen committing theft in the campus of Kanti Thermal Power. On chased, while four persons succeeded to flee away but this petitioner was apprehended with a bag containing copper scrape and other materials.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.21410 of 2017 (3) dt.17-05-2017 suspicion. It is further submitted that petitioner is in custody since 02.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M (West), Muzaffarpur, in connection with Kanti P.S. Case No. 03 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
