Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Banka (Barahat) P.S. Case No. 604 of 2020 lodged under Sections 328 and 304(B)/34 of the Indian Penal Code. The allegation of Sections 328 and 304(B) of the Indian Penal Code is against three known accused persons including the petitioner.

Learned counsel for the petitioner submits that the petitioner is the uncle of the husband of the deceased. He further submits that petitioner is separate in mess, residence and worship from the deceased & her husband. He has nothing to do

Patna High Court CR. MISC. No.12984 of 2022(3) dt.10-08-2022 2/2 with the day to day affairs of the deceased and her husband's family. He further submits that petitioner is in custody since 26.7.2021, charge sheet has already been filed and petitioner has clean antecedent.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 604 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
