The petitioners apprehend their arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 379, 354, 504, 506, 427 of the Indian Penal Code and later on, Section 302 of the I.P.C. was added. As per F.I.R., an altercation took place between two communities in a marriage ceremony, in which, both sides sustained injuries.
There is case and counter case. There is no specific allegation of assault against these petitioners. They are only alleged to be member of the mob. Specific allegation of assault is against other co-accused persons, who assaulted the deceased
Patna High Court CR. MISC. No.19046 of 2023(2) dt.24-06-2023 2/2 on his head with lathi, danda and iron rod. Some of the other similarly situated co-accused persons have already been granted anticipatory bail by this Court. Petitioners have got clean antecedent.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Ghoshi P.S. Case No. 237 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
