2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304(B) and 201/34 of the Indian Penal Code.
3. The case of the prosecution is that the daughter of the informant, namely, Parvati Kumari, was married to the petitioner in the year 2021. It is further alleged that after some time of marriage, Parvati Kumari was subjected to cruelty by the petitioner and her in-laws on account of non-fulfillment of dowry. It is further alleged that on 10.12.2023, the eldest daughter of the informant, namely, Aarti Kumari received a call from the petitioner and she was called to Bodh Gaya as there

It is further alleged that when Aarti Kumari went there, she found her sister, namely, Parvati Kumari laying dead. She also found a ligature mark in her neck. It is further alleged that thereafter, she along with the petitioner cremated the body of the deceased at Vishnupad Ghat, Gaya and after cremation of the dead body, she informed her uncle regarding the occurrence.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the victim was suffering from Hepatitis 'B' and that her death was natural. It is also submitted by the learned counsel for the petitioner that from the FIR itself, it is clear that the eldest daughter of the informant was there with the petitioner at his house and the dead body was cremated before her despite that she informed about the occurrence to her uncle after the cremation of the dead body. Moreover, the petitioner is languishing in judicial custody since 12.12.2023 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.12409 of 2025(3) dt.09-05-2025 3/3 of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bodh Gaya P.S. Case No. 914 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-XVth, Gaya.
7. However, the trial Court is hereby directed to expedite the trial expeditiously and the petitioner is also directed to cooperate in the trial and that he shall be present in Court as and when required.
