Petitioner is languishing in judicial custody since 17.02.2017 in connection with Sasaram (M) P.S. Case No. 784/2014 for offence alleged under Section 376 of the Indian Penal Code.

The prosecution case, as alleged by the informant, is that the petitioner forcibly entered into her house on 17.08.2014 and committed rape on her.

Learned counsel for the petitioner submits that he is innocent and he has no criminal history and that both the informant and the petitioner were not in good terms and has been falsely implicated due to instigation by the villagers. It has further

She filed petition on 19.09.2014 and on 25.08.2014 and stated that no such incident ever occurred and even the witnesses have not supported the prosecution case.

However, learned APP for the State opposes the prayer for bail.

Considering the facts aforesaid and materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Mufassil) P.S. Case No. 784/2014.
