The petitioner has filed the instant application for grant of regular bail in connection with Balia P.S. Case No. 340 of 2022 registered under sections 346, 370, 370(A), 371, 372, 373, 376, 120(B) of the Indian Penal Code, Sections 4, 5, 12 and 17 of POCSO Act, Sections 3, 5, 6, 7 and 8 of the Immoral Trafficking Protection Act and Sections 75 and 79 of Juvenile Justice Act.

As per prosecution case, the petitioners along with others said to have involved in immoral trafficking of the minor girls.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. It is further submitted that

No.14412 of 2023(2) dt.13-04-2023 2/3 the statement of the victim was recorded under Section 164 of the Cr.P.C., in which she has not whispered any complicity of the petitioner in this case and further stated that on the behest of one Soni, she came there and out of her own sweet will, she involved in illegal flesh trade to earn money. It is also submitted that petitioner has no concern with the alleged offence. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, she is languishing in judicial custody since 13.12.2022. Similarly situated other co-accused persons have already been granted bail by this Court vide order dated 07.04.2023. in Cr. Misc. No. 9084 of 2023 and 9161 of 2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Balia P.S. Case No. 340 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 6th-
