The petitioners are apprehending their arrest in connection with Pakribarawan P.S.Case No. 58 of 2015 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 353 and 427 0f the I.P.C.
The prosecution case is that the informant went to village- Keshochak alongwith the police officials to arrest accused Mukesh Choudhary in compliance of warrant of arrest issued by the Court. When attempt was made to arrest Mukesh Choudhary, he gave Fasuli on different parts of body of informant and 14 others named in the F.I.R. including petitioners and 20-25 unknown attacked on informant
Patna High Court Cr.Misc. No.9567 of 2016 (2) dt.11-04-2016 2/2 and others.
Learned counsel appearing on behalf of the petitioners submits that in fact there is no specific allegation against the petitioners rather they are said to be only members of unlawful assembly. Further submission is that similarly situated co-accused Gano Chaudhary and Subo Devi have already been allowed anticipatory bail vide Cr. Misc. No. 48392 of 2015 on 03.02.2016.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender within a period of six weeks from today before the Court below be enlarged on bail on furnishing bail bonds of Rs, 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nawada in Pakribarawa P.S.Case No. 58 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
