Petitioner, already in custody, seeks bail in connection with Gaya Rail P.S. Case No.03 of 2018, registered under Sections 9/48(A)/49/51 of Wild Life Protection Act, 1972. Allegation in brief is that the police recovered 230 small tortoises from the suitcase of the petitioner on the railway platform.
Learned counsel for the petitioner submits that the recovery is not from the conscious possession of the petitioner, petitioner has no criminal antecedent and he is in custody since 08.01.2018.
Having considered the said facts and circumstances, petitioner Ramiz Khan is directed to be released on bail on
Patna High Court Cr.Misc. No.13962 of 2018(2) dt.13-03-2018 2/2 furnishing bail bond of 10,000/- (ten thousand) with two ₹ sureties of the like amount each to the satisfaction of learned Judicial Railway Magistrate, Gaya in connection with Gaya Rail P.S. Case No.03 of 2018.
