JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-03-2022 Heard Mr. Prashant Kumar, learned Advocate for the petitioners and Mr. Abhay Kumar Roy for the State. The petitioners seek bail in anticipation of their arrest in connection with Goreyakothi P.S. Case No. 186 of 2019 dated 30.10.2019 instituted for the offences under Sections 302/34 of the Indian Penal Code.

The petitioners though are alleged to have assaulted the mother of the informant but the post-mortem of the deceased (mother of the informant) discloses no external injury. The deceased died because of hemorrhagic shock caused by intracranial hemorrhage. This Court wanted to ascertain whether the

The investigation papers reveal that the internal bleeding which actually caused death was because of an old ailment.

There is a Title Suit pending between the parties. Considering these aspects of the matter, the petitioners were granted provisional bail by order dated 02.02.2022.

The investigation papers do not reveal anything otherwise.

For the reasons aforestated, the provisional bail granted to the petitioners vide order dated 02.02.2022 is, hereby, confirmed. The petitioners shall remain on the same bail bonds. The application stands allowed.
