Learned senior counsel appearing on behalf of the University submits that the representation as contained in Annexure-9 is pending at the level of the Vice-Chancellor of the University and the Vice-Chancellor will take appropriate decision.
Patna High Court CWJC No.4256 of 2020(2) dt.27-02-2020 2/2 It is to be noted that on numerous occasions this Court has held out that the auditor of the State has no business in the matter of pay fixation as there is statutory Committee for the same.
Noticing the totality of the facts of the case, the writ petition is disposed of with the direction to the Vice-Chancellor of the University to take appropriate decision on the representation filed by the petitioner taking into consideration the judgment of the Apex Court in the case of Durga Prasad Singh & Ors. Vs. State of Bihar & Ors. Civil Appeal No. 61766177 of 2015 and Civil Appeal No. 6290 of 2015, as contained in Annexure-6 to the writ petition. Final decision in this regard must be taken by the University at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order . With the aforesaid observations and directions, the writ petition stands disposed of.
