The petitioner seeks regular bail in connection with Gurua P.S. Case No. 28 of 2021 for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution story, in brief, is that on 06.02.2021 on confidential information, the informant along with other armed forces reached the house of Sunil Chaudhary (petitioner) of village Tarma Dhibra and on search 20 litres of country made wine was recovered from the house of the petitioner Sunil Chaudhary and the same was seized and the accused managed to

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner. He has no concern either with the manufacturing of liquor or its trade in any manner. Petitioner is in custody since 15.07.2021.

Learned A.P.P. for the State has opposed the prayer for grant of bail to the petitioner.

Considering the aforementioned facts and circumstances of the case and period of custody undergone by the petitioner, without going into the merits of the case, the provisional bail granted to the petitioner is confirmed on same terms and conditions contained in order dated 30.03.2022.
