JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 498A of the I.P.C.

Allegation is that the accused persons including the petitioner assaulted and tortured the daughter of the complainant in various ways and they ousted her from the matrimonial home. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.2.2017. Petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. No specific allegation has been made against him. The petitioner has further relied upon the

Patna High Court Cr.Misc. No.22944 of 2017 (2) dt.23-05-2017 2/2 decision of this court in the case of Md. Naimul Haque Ansari @ Naimul Haque Ansari & ors. vs. The State of Bihar, reported in 2006(3) PLJR 182.

On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-cum-A.C.J.M., Muzaffarpur in connection with Complaint case No.1551 of 2011 (Trial No.566 of 2017).
