Petitioner, already in custody, seeks bail in connection with Parsa P.S. Case No.13 of 2017, registered under Sections 406, 420, 376, 504, 506 and 120(B) of the Indian Penal Code. Allegation in brief is that on the false promise of getting marry with the prosecutrix, the petitioner established sexual relationship but denied to marry with her.

Learned counsel for the petitioner submits that the prosecutrix wanted to marry with the petitioner, when the proposal was refused then she lodged the false case alleging physical relationship for last seven years, the informant is in the habit of lodging frivolous cases, she has also lodged another

Patna High Court Cr.Misc. No.14211 of 2018(2) dt.13-03-2018 2/2 case being Parsa P.S. Case No.99 of 2017 against the petitioner and others but police found the case false and the petitioner is in custody since 07.09.2017.

Having considered the said facts and circumstances, petitioner Upendra Kumar @ Upendra Rai is directed to be released on bail on furnishing bail bond of 10,000/- (ten ₹ thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Chapra, Saran in connection with Parsa P.S. Case No.13 of 2017, giving rise to S.T. No.11 of 2018.
