====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.
3. According to F.I.R., this petitioner took Rs. 1 lac from the informant in the year 2014 ensuring him to double the amount in five years but after completion of five years when informant asked for his money, this petitioner avoided to return the same. It is further alleged that the petitioner has not returned the money to informant till date, despite several requests.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, petitioner was working as an agent on commission basis with the Welfare Building & Estates Pvt. Ltd. and he had

No.11967 of 2025(3) dt.03-04-2025 2/3 apprised the informant about investment scheme of the company which was voluntarily opted by the informant regarding which petitioner had provided proper documents in the name of company. The entire amount was invested in the aforesaid company and not a single penny was used by the petitioner. Moreover, co-accused Kamlesh Prajapati, who was Manager and in-charge of the operation has paid the entire disputed amount to the informant vide cheque Nos. 000536, 000537, 000602, 000603, 000604, 000605, 000538 and 000539 of Rs. 25,000/- each. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Deo P. S. Case No. 317 of 2022, subject to condition as laid down under Section 438(2) of the
Patna High Court CR. MISC. No.11967 of 2025(3) dt.03-04-2025 3/3 Code of Criminal Procedure.
