JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-09-2015 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Opposite Party No.2.

The petitioner seeks pre-arrest bail in connection with Complaint Case No. 179 of 2013 in which cognizance has been taken under Section 498-A of the Indian Penal Code. It is contended that that the allegation of demand of dowry after four years of marriage is patently false and without any substance. The petitioner has never subjected the complainant to cruelty and as a matter of fact the instant case has been instituted due to matrimonial discord and incompatibility.

He has submitted that there is allegation that the petitioner subjected the complainant to cruelty for non-fulfillment of demand of Rs.1,00,000/- as dowry. Be that as it may, regard being had to the nature of allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Katihar in connection with Complaint Case No. 179 of 2013, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
