Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and 3(1) (II) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
The prosecution case is that the informant while walking in the orchard of Dhanurdhari Rai was called by the petitioner and abused by calling caste name. An attempt was also made to urinate on his mouth and gave threatening to kill his family members.
It is submitted by the learned counsel for the petitioner that no motive of occurrence has been alleged in the First Information Report. The petitioner has helped the informant during the marriage of his daughter. Statement has
Patna High Court Cr.Misc. No.8740 of 2016 (2) dt.24-02-2016 been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the nature of accusation, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dumaraon P.S. Case No. 360 of 2015, pending in the court of learned Chief Judicial Magistrate, Buxar.
With the above observation this application is disposed of.
