2. The petitioner apprehends his arrest for the offences alleged under Section 3 Railway Property (Unlawful Possession) Act registered in connection with Samastipur R.P.F. (S.P.J.) Case No. 3 of 2015.

3. It is submitted that the petitioner has been falsely implicated as in fact the petitioner had suffered the loss of the money by reason of theft and the money has since been recovered from one Pankaj Kumar Singh. Coaccused Banti Kumar who was named in the confessional statement of the said Pankaj Kumar Singh has been granted anticipatory bail by this Court.

4. Having regard to the entirety of the facts and

No.8294 of 2016 (2) dt.12-04-2016 circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Railway Judicial Magistrate, Samastipur, in connection with Samastipur R.P.F. (S.P.J.) Case No. 03 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
