02. In the present case, the petitioner seeks bail in connection with Marhowrah P.S. Case No. 378 of 2017 registered for the alleged offences under Sections 392 of the Indian Penal Code.
03. As per prosecution case, three bike borne miscreants at the gunpoint snatched the bag of the informant containing Rs. 50,628/- cash, a bio-metric machine, some documents etc. The name of petitioner transpired during investigation for being involved in the said occurrence.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the
Patna High Court CR. MISC. No.12458 of 2025(2) dt.07-03-2025 2/3 possession of the petitioner, who has not been put to any Test Identification Parade. The name of petitioner transpired in this case on the basis of confessional statement of co-accused Rockey Kumar and except for this no material has come up on record to connect the petitioner with the offence as alleged. The petitioner is having antecedent of four cases. The petitioner is in custody since 18.11.2024 and charge-sheet has been submitted.
05. Learned APP for the State opposes the prayer for bail submitting that the name of petitioner transpired as one of the accused persons who looted the informant.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah P.S. Case No. 378 of 2017, subject to the conditions mentioned in Section 437(3) of the Cr.P.C. and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
