JUSTICE ARUN KUMAR ORAL ORDER 13-03-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Rahika P. S .Case No. 19 of 2017 corresponding to G.R. No. 9/2017, registered under Sections 341, 323, 354 (B) of the Indian Penal Code as well as under Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that the informant was having love affairs with another co-accused, Diwakar Paswan, for which a separate case was instituted and this fact is recorded in her statement under Section 164 Cr. P. C. in an earlier case instituted against him, moreover the allegation against the petitioner is not specific rather it is against co-accused, Diwakar Pawan and petitioner, is in

Patna High Court Cr.Misc. No.14298 of 2018 (2) dt.13-03-2018 2/2 custody since 15.12.2017.

Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge- cum Special Judge, POCSO Act in connection with Rahika O.S. Case No. 19 of 2017.
