JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 467, 468, 420, 120(B) and 34 of the Indian Penal Code.
The allegation against the petitioner is that he along with other accused persons cheated him and grab his Rupees ten lac and fifty thousand by giving false information about the land. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. The main allegation is against co-accused Natho Rajwar, who had received the consideration amount against the land, in question, which was being sold by the said co-accused. As far petitioner is concerned, he is only witness.
Patna High Court Cr.Misc. No.11101 of 2016 (2) dt.25-04-2016 2/2 On behalf of the State and the informant, it is submitted that the petitioner is named in the FIR and the petitioner had also participated to the conspiracy.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,Nawada in Nawada Town P.S.Case No. 343 of 2014,subject to the conditions as laid down u/s 438(2) Cr.P.C.
