The petitioner seeks bail in connection with Barauni Rail P.S. Case No. 15 of 2017, registered under Section 363 and 365 of the Indian Penal Code.
The accusation is that Sunil Kumar Sah @ Tinku, husband of the informant, had gone to his relation along with this petitioner on 19.07.2014, while petitioner returned in the village, but husband of the informant was not returned with the petitioner. On enquiry, petitioner disclosed that Sunil Kumar Sah, in course of returning from relation, got down from the train near Rajendra bridge for taking water, but he did not return. The informant raised suspicion having hand of the petitioner in
Patna High Court Cr.Misc. No.23769 of 2017 (3) dt.28-06-2017 2/2 missing of her husband.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. Further submission is that after investigation, Chargesheet has already been submitted in this case against the petitioner and no tangible material has been shown against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Railway, Barauni in connection with Barouni Rail P.S. Case No. 15 of 2017.
