The petitioner apprehends his arrest in Mahua PS Case No. 741 of 2022 registered for the offences punishable under Section 414/34 of the Indian Penal Code and sections 30(a), 32(ii), 34(ii), 41(i) of the Bihar Prohibition and Excise Act, 2016.

Total 2079 litres of illicit liquor has been recovered from a pick-up van.

It is submitted that petitioner has falsely been implicated in this case merely on suspicion. Nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question. Counsel for State however vehemently opposed the prayer for bail and submitted petitioner has got criminal antecedent and six cases of similar nature are pending against

Patna High Court CR. MISC. No.12796 of 2023(2) dt.07-04-2023 2/2 him.

Considering the facts aforesaid and criminal antecedents of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
