Petitioner is apprehending his arrest in connection with Sakra P.S.Case no.483 of 2018 dated 1.11.2018 , registered for offences punishable under Sections 341, 323, 447, 448, 354, 324, 379, 504, 506 and 307/34 of the Indian Penal Code. Allegation against the sole petitioner is that he along with the other accused persons thrashed the informant on the ground and started assaulting him by lathi and danda and specific allegation against the petitioner is that he assaulted by sword causing injury and there is also allegation of snatching of Mangalsutra.

Submission of the learned counsel for the petitioner is that he has been implicated in this case as the informant has enmity with one Shivnath Sah as wife of Shivnath Sah had lodged a complaint case against the informant prior to

Patna High Court CR. MISC. No.20425 of 2019(4) dt.02-08-2019 2/2 this occurrence and the petitioner was working in the house of Shivnath Sah . Moreover the injury report disclosed that the injures are simple in nature.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the learned trial court that once the petitioner appears he will verify the injury report and if the submission is found to be correct that injuries are simple in nature, the petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM cum Sub Judge 13th, Muzaffarpur in connection with Sakra P.S.Case no.483 of 2018 dated 1.11.2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the above direction, this application is disposed of.
