The petitioner seeks bail in Nagarnausa P.S. Case No. 20 of 2021, registered for the offence punishable under Section 397 of the Indian Penal Code.

As per the prosecution case, on 12.02.2021 at about 10.30 pm while the informant and family members were sleeping, 6 to 7 unknown miscreants entered the house of informant and looted cash, ornaments, laptop and other household articles. They also committed loot in the house of neighbour.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of petitioner transpired during course of investigation on the basis of confessional statement of co-accused Vijay Kumar. No looted article has

Patna High Court CR. MISC. No.12622 of 2022(2) dt.09-05-2022 2/2 been recovered from possession of this petitioner. Petitioner has not been put on test identification parade till date. Petitioner is in custody since 14.09.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Hilsa, Nalanda in connection with Nagarnausa P.S.
