The petitioner seeks regular bail in connection with N.D.P.S. Case No. 63 of 2018 arising out of Turkauliya P.S. Case No. 691 of 2018 registered for the offence punishable under Section 414 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 20, 22, 23 and 27 of the N.D.P.S. Act.

The allegation is of recovery of 500 grams of charas from the possession of the co-accused, namely, Ravi Raj from whose possession one country made loaded pistol is also said to have been recovered.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.13309 of 2019(2) dt.26-03-2019 2/2 the petitioner has been falsely implicated in the present case and though he is accused in two other case but he is on bail in the said to cases. It is further submitted that the petitioner is languishing in custody since 19.10.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, East Champaran, Motihari in connection with N.D.P.S. Case No. 63 of 2018 arising out of Turkauliya Case No. 691 of 2018. (Mohit Kumar Shah, J) S.Sb/- U T
