This is a petition for grant of regular bail for offence under Sections 400, 401, 413, 414, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.
Co-accused, Deepak Kumar, was apprehended along with a stolen motorcycle. He confessed before the police that the petitioner used to purchase the stolen motorcycle from him and others. Thereafter, the police recovered the said motorcycle from near by the house of this petitioner.
Submission of the learned counsel for the petitioner is that he has got no criminal antecedent and recovery was not from the possession of the petitioner. Only material is confession of the co-accused, before the police, which has got no evidentiary value.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like
Patna High Court Cr.Misc. No.22084 of 2017 (3) dt.22-06-2017 2/2 amount each in connection with Bahadurpur P.S. Case No. 45 of 2017 to the satisfaction of the Chief Judicial Magistrate, Darbhanga, or successor Court.
