JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 379 and some other minor Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, this petitioner along with other FIR named accused persons made firing and committed loot in the house of informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that both parties are agnates and there is land dispute between them. The present case is counter blast of Rani Talab PS case No. 231/ 2020 lodged by petitioner side against the husband and son of the informant. Similarly situated

Patna High Court CR. MISC. No.14188 of 2022(2) dt.23-08-2022 2/2 accused Ajay Yadav and others have already been granted pre arrest bail by this court vide order dated 05.07.2022 passed in Cr. Misc. No. 61058/ 2021.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateII, Danapur, Patna in connection with Ranitalab PS case No.230/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
