The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.
Recovery is of 105 liters of country made liquor.
It is submitted by learned counsel for the petitioner that recovery is not from the land of the petitioner and the seizure list reflects that land has been shown to be in possession of the petitioner whereas the petitioner denies of his possession of the same. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good grounds for prayer of regular bail if the petitioner
Patna High Court Cr.Misc. No.7748 of 2015 (3) dt.02-03-2015 2 / 2 surrenders within a period of six weeks from the date of receipt/production of copy of the order in connection with Excise Case No. 01 of 2015, pending in the court of the learned C.J.M. Gaya.
With this observation, the application is disposed off.
