This is a petition for grant of regular bail for offences under Sections 406 and 420 of the Indian Penal Code.
According to first information report someone telephoned to the informant that his son is seriously injured in road accident at Haridwar and Rs.10,000/- is needed for his treatment. The money should be deposited in the referred account. The informant deposited the money. The account was of the petitioner.
Submission of the petitioner is that Vikas, a covillager of the petitioner had asked the petitioner to receive the money in his account and hand over the same to Vikas, which the petitioner followed. The
Patna High Court Cr.Misc. No.21992 of 2017 (2) dt.08-05-2017 2/2 petitioner has stated on oath that he has got no criminal antecedent and he is ready to deposit the amount in the account of the informant.
Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Minapur P.S. Case No. 254 of 2015 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, or successor Court with the condition that the petitioner shall refund the amount in the account of the informant before filing of the bail bond.
