JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kotwali (Basdevpur) P.S.Case No. 292 of 2017 registered under Sections 302/34 of the Indian penal Code and Section 27 of the Arms Act.

Allegation in brief is that informant's husband objected Situ Yadav while he was doing some crime in front of her house, when the informant's husband went to his house then all accused persons turned up and Situ Yadav shot at her husband due to which he died.

Submission is that only allegation of firing at the informant's husband is against Situ Yadav and not against any other person and similarly situated another co-accused Rajesh Mandal has been granted bail by the court below itself.

No.14825 of 2018 (2) dt.15-03-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Sukesh Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kotwali (Basdevpur) P.S. Case No. 292 of 2017.
